Tree overhanging private property

Crab apple tree overhanging private property from public footpath behind, shedding rotting apples into our garden which is attracting pests, preventing use of the garden in summer months and the smell of fermenting fruit is causing allergy issues to family members. We have had a tree surgeon visit site to advise. He has suggested that pruning to thr boundary line would cause the tree to become unstable. They suggested the removal of the tree , hence why we are writing to yourselves in the hope that you can resolve the issue.
